O'Malley Moving Bins Terms of Service
By purchasing, using, and/or accessing the services of How Can I Help Organize LLC, doing business as O’Malley Moving Bins, you are deemed to have read and agreed to the following Terms of Service.
The following terminology applies to these Terms of Service: “Renter”, “You” and “Your” “OMB”, “Ourselves”, “Our”, “We”, and “Us” refers to How Can I Help Organize LLC, doing business as O’Malley Moving Bins, and/or its employees, representatives, agents, or others for whom we are legally responsible. “Party” or “Parties” refers to both the Renter and ourselves, or either the Renter or ourselves. “Services” refers to any and all services, programs, products and/or other offerings on our website, including, but not limited to the renting, delivery and pick up of the equipment. “Equipment” means any and all equipment rented to the Renter, including but not limited to the bins. “Rental Period” means the duration of the rental of equipment from OMB to the Renter as identified on the Renter’s invoice. “Website” refers to https://omalleymovingbins.com/ (and/or successor, affiliated or associated domains). These Terms of Service apply to all users of our services and/or equipment. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she/it or they, are taken as interchangeable and therefore as referring to same.
Overview of Services
Upon purchase of our services, OMB shall rent the equipment to the Renter for the rental period. At the commencement of the rental period, OMB shall deliver the equipment to the Renter’s current address and at the end of the rental period, will pick up the equipment from the Renter’s new address. OMB does NOT assist with packing or moving, which shall be the sole responsibility of the Renter. All equipment shall remain the sole and exclusive property of OMB.
Rental Period
OMB’s standard and minimum rental period is fourteen (14) days. Should the Renter require the equipment for a shorter period of time, the Renter will still be charged for a fourteen (14) day period, regardless of whether the equipment is returned before the end of the rental period. OMB may accommodate longer-term rentals, subject to equipment availability.
Delivery Area
OMB only provides services to Renters located within Long Island, New York, specifically within Suffolk County and Nassau County. Delivery and pick-up of equipment must occur within these counties. OMB does not provide services outside of Long Island. Any requests outside this service area will be declined at OMB’s sole discretion.
Reserving Equipment
The Renter must visit the desired Package page on the website and choose the length of its rental period, subject to the above restrictions. The minimum amount of bins a Renter can rent is twenty (20) bins. The Renter can also choose from optional equipment add-ons after adding the Renter’s desired number of bins to its cart. Once the Renter has submitted its order on our website, OMB will check availability of equipment and, if sufficient equipment is available, OMB will send the Renter an email confirming the rental with further instructions as to next steps. For greater certainty, submitting an order on our website is NOT a guarantee of equipment availability. OMB encourages all Renter’s to read the FAQ’s on our website to better understand the rental process.
Payment
Payment is due IN FULL upon purchasing our services. Upon checkout on our website, the Renter must submit credit card payment (Stripe).
- If paying via credit card, the Renter will select credit card as its chosen method of payment. OMB uses Stripe as a third party credit card payment processor and will not have access to the Renter’s credit card number, except for the last four (4) digits. Stripe accepts payment via MasterCard, Visa, American Express, and Discover. Upon checkout, a pre-authorization will be initiated for the full amount owing for OMB’s services; however, this amount will not be processed until OMB has checked equipment availability and confirmed the Renter’s order.
By agreeing to these Terms of Service, you hereby agree to pay all fees and charges specified on our website, including under these Terms of Service, for the services for which you purchase. All fees are exclusive of applicable taxes, unless otherwise stated, and you are solely responsible for the payment of any such tax that may be imposed on your use of the services. We will charge any fees or other payments you authorize to the account and credit card you designate. If payment is not received from your credit card or other payment method, you agree to pay all amounts due on demand by us. We reserve the right to change the fees for our services or charge a fee where one was not previously charged. All fees charged are final and non-refundable, except as explicitly set out herein.
Changes to Order
OMB requests that Renter’s call, text, or email OMB immediately upon requiring a change to its rental period or an increase to the amount of equipment ordered. OMB will try to accommodate the change, subject to equipment availability.
- For requested changes to the rental period, if the length of the rental period is not changing but the dates are, OMB will accommodate the change free of charge, subject to equipment availability. If the length of the rental is increasing, OMB will accommodate the change upon payment of the applicable additional rental fee for the extended rental period, subject to equipment availability. If OMB cannot accommodate the new dates and the Renter needs to cancel its order, OMB will process the cancellation, subject to the cancellation policy.
- For requested changes to the amount or type of equipment, the Renter can request additional equipment. Subject to availability and upon payment for the additional equipment and delivery fees, if the original order has already been delivered to the Renter, the Renter will be emailed a link to schedule another Delivery, and will pay a delivery fee even if the Renter qualified for free delivery on their previous order. If the order has not been delivered yet, there will be no extra delivery charges and the Renter will just pay the difference.
Cancellation Policy
OMB may offer a refund if the Renter cancels its order more than forty-eight (48) hours prior to its scheduled delivery time. For a successfully cancelled order, the full amount will be refunded to the Renter, LESS a five percent (5%) administrative fee. If a Renter cancels its order within forty-eight (48) hours, the Renter will not receive a refund, but will receive an OMB credit for the amount of the order LESS a five percent (5%) administrative fee that can be used toward future rentals of equipment. OMB credits expire one (1) year from the date of issuance. If the Renter cancels its order after delivery of the equipment, there will be no refund or credit given to the Renter.
Delivery
- OMB delivers exclusively within Suffolk County and Nassau County, New York. All deliveries include a delivery fee, as listed on the respective Package pages. OMB does not deliver outside of Long Island.
- Within seven (7) days of the commencement of the Renter’s rental period, the Renter must pay the damage deposit as well as select a Delivery date and time.

There may be occasions where OMB is fully booked for delivery or where limited time options are available. In such cases, at our sole discretion, OMB may offer the Renter a free extra rental day and come the day prior to the rental period, subject to equipment availability.

OMB will send an automated text reminder to the Renter twenty-four (24) hours prior to the scheduled one (1) hour window, so that the Renter is present for the delivery.

OMB expressly reserves the right to change the Renter’s delivery date and/or time should an emergency or unforeseen circumstance arise, and in no event shall OMB be liable for any damages resulting from such change.
Pick Up
- OMB offers free pick up for all addresses located within Suffolk County and Nassau County, New York. OMB does not provide pick up services outside of Long Island.
- After delivery of the equipment, the Renter may schedule their Pick Up date and time at their convenience. If the Renter is not yet ready to choose a Pick Up time, they may wait and request their preferred time once their schedule is known. When the Renter is ready, they may Request their Pick-Up.

There may be occasions where OMB is fully booked for pick up or where limited time options are available. In such cases, at our sole discretion, OMB may offer the Renter a free extra rental day and come the day after the rental period, subject to equipment availability.

OMB will send an automated text reminder to the Renter twenty-four (24) hours prior to the scheduled one (1) hour window, so that the Renter is present for the pick up.

OMB expressly reserves the right to change the Renter’s pick up date and/or time should an emergency or unforeseen circumstance arise, and in no event shall OMB be liable for any damages resulting from such change.
Refused Entry
If the Renter does not select a Pick Up date and time, refuses to allow OMB to pick up the equipment, or does not answer the door at the confirmed Pick Up address during the scheduled Pick Up window, penalties may apply, as the equipment may be required for another customer.
OMB reserves the right to charge additional fees if:

OMB arrives for a scheduled Pick Up and the Renter is not available or does not provide access to the equipment;
-
The Renter fails to schedule a Pick Up time within fourteen (14) days after the end of the rental period; or
-
OMB must make additional trips to attempt Pick Up due to the Renter’s unavailability.
If OMB is unable to pick up the equipment within fourteen (14) days after the end of the rental period due to the Renter’s failure to schedule or provide access, the Renter may be charged the full replacement cost of the equipment, as specified below.
Condition of Equipment
OMB warrants that all equipment will be in satisfactory operating condition at the time of delivery, subject to reasonable wear and tear.
Upon delivery, the Renter is encouraged to carefully inspect the equipment to determine whether any damage occurred during delivery. The Renter must notify OMB within twenty-four (24) hours of delivery if any damage is identified. OMB may replace such equipment free of charge, with no additional delivery fees.
If the Renter fails to notify OMB of any damage within twenty-four (24) hours of delivery, the equipment shall be deemed accepted by the Renter in good operating condition.
Damage Deposit
Upon scheduling a Delivery and Pick Up date and time, OMB will place a damage-deposit pre-authorization of $150.00 on the Renter’s credit card to encourage the proper care of our equipment.
This pre-authorization will not be fully charged unless OMB determines that equipment has been lost, damaged, or not returned in accordance with these Terms of Service. If repair or replacement costs exceed $150.00, the Renter will be responsible for the full replacement value of the affected equipment.
Cleaning Fees
OMB inspects, cleans, and sanitizes all equipment with an eco-friendly cleaner prior to delivery. The Renter is not required to clean the equipment before Pick Up; however, if OMB determines that any equipment contains excessive dirt, debris, spills, or pet hair, OMB may charge a cleaning fee of $2.00 per bin or piece of equipment.
This fee may be deducted from the Renter’s damage-deposit pre-authorization.
Replacement Fees
Proper care of the equipment during the rental period is the responsibility of the Renter. If any equipment is lost, stolen, damaged, or not returned (whether accidental or intentional), the following replacement fees will apply:
Bins & Dollies

Add-Ons

Laundry bags: $15 per bag ($30 per set of 2)

Foam sheets: $10 per pack of 30 (or $0.50 per sheet)

Hand trucks: $75 per hand truck
OMB may deduct these fees from the Renter’s $150 damage-deposit pre-authorization. If the replacement costs exceed $150, the Renter will be responsible for paying the remaining balance to the credit card on file.
All equipment must be stored indoors to prevent damage or theft. The Renter shall not apply tape, stickers, or zip ties to any equipment except for the labels provided by OMB, and these labels must be placed only in the designated label area below the handles. No alterations or modifications may be made to the equipment without written permission from OMB.
DISCLAIMER NOTICE - Exclusions and Limitations
By purchasing and/or using our services and/or equipment, you acknowledge and agree that there is some inherent risk involved in using moving equipment. You confirm that you, and anyone using the equipment, are physically and mentally able to handle the equipment safely. You understand and agree that the sole risk and responsibility for personal safety while using OMB’s equipment rests with you, the Renter.
Limitation of Liability & Indemnification
To the fullest extent permitted by law, OMB excludes all representations and warranties related to OMB’s website, services, equipment, and their contents, except for any warranties expressly stated in these Terms of Service.
OMB is not liable for any damages arising out of or in connection with your purchase and/or use of our services and/or equipment, including, without limitation, personal injury, death, or property damage.
To the fullest extent permitted by law, OMB will not be liable to you (or to your heirs, executors, or representatives) for any special, indirect, incidental, consequential, or punitive damages arising out of or related to the use of our equipment or services, whether such liability arises from contract, warranty, negligence, strict liability, or any other legal theory, even if OMB has been advised of the possibility of such damages.
By accepting these Terms of Service, you hereby release and forever discharge OMB from all claims, losses, damages, liabilities, and expenses of any kind arising out of or related to:

(a) your violation of any provision of these Terms of Service; and
-
(b) your purchase and/or use of OMB’s services and/or equipment.
The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
Indemnification
By purchasing and/or using OMB’s services and/or equipment, you agree to indemnify and hold OMB harmless from any and all claims, losses, damages, liabilities, and expenses — including, but not limited to, litigation expenses, legal fees, awards, or costs — arising out of or related to:

(a) your violation of any provision of these Terms of Service; and
-
(b) your purchase and/or use of OMB’s services and/or equipment.
Rules & Warnings
To reduce the risk of injury or damage, the following rules apply to all uses of OMB’s equipment:

Bins shall not be stacked more than four (4) bins high when packed.
-
Bins shall not be filled beyond the maximum weight capacity of sixty (60) pounds.
-
Use caution around the steel hinge rods located in the lid area of the bins, as they may catch on clothing or scrape skin.
-
Children are not permitted to use, move, or play with the equipment.
-
Animals shall not be placed in or on the equipment.
-
OMB’s equipment shall not be used for any unlawful purposes or for any purposes prohibited by these Terms of Service.
-
The Renter is solely responsible for determining safe use of the equipment, including lifting, carrying, loading, stacking, and who is permitted to handle the equipment.
Additional Safety Warnings

Bins must not be dragged across floors, as this may cause damage to the floor or the bins.
-
Bins must not be used as step stools, ladders, stools, or platforms.
-
Bins and dollies must be kept indoors when not in active use to prevent weather damage, warping, or theft.
-
Dollies must be used on flat, stable surfaces and should never be ridden or stood on.
-
Do not overload dollies or attempt to push/pull more weight than you can safely control.
-
Do not attempt to modify, drill, tape, glue, write on, or permanently mark the bins or accessories except for using OMB-provided labels in the designated label area.
-
Keep fingers away from the hinge areas when closing the lids to prevent pinching injuries.
Termination of Service
Your access to and/or use of OMB’s services and/or equipment may be terminated by OMB at any time, in OMB’s sole discretion. The Renter acknowledges and agrees that, in the event of default or breach of any term of these Terms of Service, OMB shall be entitled to enter the premises where the equipment is located to recover the equipment.
All costs and expenses incurred by OMB to recover the equipment — including, but not limited to, collection costs and legal fees — shall be immediately due and payable by the Renter to OMB.
Events Beyond Our Control
OMB is not responsible for any delay, interruption, or failure to perform our obligations if such issues are caused by events outside of our reasonable control. These events may include, but are not limited to:

acts of nature (such as storms, floods, hurricanes, or earthquakes),
-
power outages or utility failures,
-
government restrictions, regulations, or shutdowns,
-
civil unrest, riots, or labor disputes,
-
acts of terrorism or war,
-
epidemics, pandemics, or public-health emergencies, or
-
any other unexpected or unavoidable event that prevents OMB from operating normally.
If such an event occurs, OMB’s obligations will be suspended for the duration of the event. OMB will make reasonable efforts to resume services as soon as safely possible. These events will not constitute a breach of these Terms of Service, and OMB will not be liable for any resulting delays or inability to perform.
General
By purchasing and/or using OMB’s services or equipment, you represent that you are at least the age of majority in your state of residence.
These Terms of Service are governed by the laws of the State of New York, without regard to conflict-of-law principles. By using our services, you agree that any disputes arising out of or relating to these Terms of Service or your use of OMB’s equipment will be resolved exclusively in the courts located in Suffolk County, New York.
If any part of these Terms of Service is found to be invalid or unenforceable, that portion will be removed, and the remaining terms will continue to be fully enforceable.
Our failure to enforce any provision of these Terms of Service shall not be considered a waiver of that provision or any other rights we may have.
These Terms of Service may not be amended, modified, or supplemented unless agreed to in writing and signed by OMB.
Notification of Changes
These Terms of Service were last amended on November 14, 2025. OMB reserves the right to update or modify these Terms of Service at any time. Any changes will take effect immediately upon being posted on our website. The Renter’s continued use of OMB’s services and/or equipment after any such update will constitute acceptance of the revised Terms of Service. Renters are encouraged to review this page periodically to stay informed of any changes.
By purchasing and/or using OMB’s services, you acknowledge and agree that you have read, understood, and accepted the Terms of Service contained herein.
